Close your account. If you keep getting overdrafts the bank will report you and you will be unable to have a bank account for up to 7 yrs. The payday loan place is going to come after you for payment. If they take you to court you will be found to owe them the money but the court will set up a payment plan more suitable. Do not let them frighten you with hardcore collection tactics- they have to follow the law. Go to a bookstore and read up on how to deal with collectors. If you decide to get out of debt and the best way is to not have a checking account but still owe debit payday loans and want to close the checking account wil this cause a felony to be issued by the payday loan company even thow you do plan on settling the owed money to the payday loan ... No way. a) It's too hard to prove that you intended to defraud the Payday institution. b) A state/ district attorney's office would have to formally charge you with a crime, which they would never do. They're already bogged down with gang bangers and drug dealers to deal with some slimy Payday lender. c) But, you need to fully expect that Payday lender to come after with guns ablaze. My best piece of advice is not to get one at all. As you might know from your previous experience, these are way too hard to get caught up in. If you feel there are no other alternatives, avoid the online sites. They all charge much higher interest and use Teletrack. Teletrack is a system used by the payday loan industry to track loan activity. Most of your local payday loan companies either don't use it or have stopped using it.
