| You have a big task in front of you. I have been in a similar situation, but resolved it in the resolution meeting. Does your child have a Behavior Intervention Plan? Did you ever have a Manifestation meeting? I would go to wrightslaw.com and read all you can to prepare yourself. Organize all your files. I can't afford a lawyer, but I want to get services for my special needs child that the school district is denying us in California (LA area). We know our rights and know the USD will not give in to parents without legal counsel. We have a meeting (IEP) in May for the next year and they fired the aide that was assisting him in class. We also know the new teacher is not credentialed for Special Ed but the principal sent home a letter that stated she was a Special Education Teacher...that is a bold face lie and they should be sued on those grounds alone. | I'm not sure exactly who you should go to, but you might try speaking with a local Department of Education Office of Civil Rights (link below). They handle discrimination cases and that type of thing - if the school is denying your child services that he needs, then I'm pretty sure they can help you with this at no cost to you. If your child hasn't officially been diagnosed as special needs, however, the school is probably not obligated to offer extra services. | There is a serious difference between overall slow learners, and those who are learning or physically disabled. Most programs seek to avoid mixing the two, as each group has different learning needs. However, due to funding and staffing concerns, it does happen. The teacher must do the best he/she can to deal with both sets of divergent learning needs when that happens. i was unjustly fired from my teach.job altho'had a contract. am single parent-how can i sue private school this was in a private school and i had a year's contract. there was no warning, i had 1 hour's notice and no closure with the kids in 2 different classes. The parents and kids were all happy and are willing to sign a petition stating so. There was no bad faith on my part. Everyone was shocked and i want to sue for the money due on my contract for the rest of the year (who can find a job in the middle of the year). | I guess I can assume you aren't unionized. If you are speak to your union rep. If not I'm sure you could find a lawyer that can help you by looking in the phone book. My daughter has an IEP which states she needs Occupational Therapy.She did not receive it all year because of "conflicts" between the teacher and the Therapist.I just found out about it.They both basically stated they did not think anyone cared!!I actually work for the same school but I have been on leave because I have been in the Hospital 6x.The V.P. just became aware of it as I did at her IEP meeting.She did say she will make sure she has sevices until the the end of the school year to make up for it.But,I am still FURIOUS!! | I think it is important you send a letter in writing to the IEP manager and to the superintendent stating your displeasure of this situation. This way if you start to have problems you have documentation. Keep a copy for yourself. Legally, the school screwed up and has attempted to make amends for it. However, if daughter's school continues to be so relaxed regarding delivery of services, you have proof. Your job needs to be based on your abilities as a teacher.
